Our Commitment to Privacy

Your privacy is important to us. To better protect your privacy, we provide this notice explaining our online information practices. This notice applies to all information collected or communicated to Unseen. Please note that this policy is subject to change.

This Privacy Policy describes the personal data collected or generated (processed) when you use Unseen’s websites (“Sites”). It also explains how your personal data is used, shared and protected, what choices you have relating to your personal data, and how you can contact Unseen. This Privacy Policy describes how Unseen, 614 Main Ave, Fargo, ND 58103 (“Unseen,” “we,” or “us”) collects, uses, and shares your personal data/provided information.

WHO is Responsible for the Processing of Your Personal Data?

Unseen is responsible for the processing of your personal data; the use will depend on how you interact with Unseen’s Sites. Unseen is referred to as “Unseen”, “our”, “we”, or “us” in this privacy policy.

Unseen has two active websites: weareunseen.org and unseenpartners.org.

WHAT Personal Data Do We Collect and WHEN?

We ask you for certain personal data to provide you with the products or services you request. For example, when you donate online, request to receive communications, apply to intern, apply to volunteer, apply to freelance, apply for an available career position, or apply for partnership via our Sites.

This personal data includes, but is not limited to, your:

- Contact details including name, email, telephone number, and shipping, billing address
- Personal details including relevant skills/training/education, time availability, t-shirt size, reference names and their contact information, title/role
- Payment or credit card information, donated amount
- Resume, website, portfolio
- Reason for contacting Unseen and any other additional comments an individual may have

WHY and HOW Do We Use Your Personal Data?

Unseen collects and uses personal data only as necessary for the purposes listed below. 

To Process Applications
When you use our Sites, we will use your personal data to provide the requested product or service.  For example, if you apply for partnership with Unseen, we will use the contact information you give us to communicate with you about partnership with Unseen. If you apply to freelance, volunteer, or intern with us, Unseen will use your provided information to review your portfolio, resume and/or skills to decide your application status. If you contact our info or partner gmail account, we will use information about you, such as your name and email, or your organization name to help you resolve a problem or question regarding your application. 

To Process Transactions through our Secure Online Donation Feature
If you donate monetarily via our Site, Unseen will use your provided payment information to complete the transaction. Unseen may also save your name, address, phone number, and email to follow up with a thank you letter, receipt for tax purposes, and ongoing communications for future donations. If you are an existing donor of Unseen (for example, if you have donated to us previously), we may use the contact details you provided to send you marketing communications about Unseen. These include, but are not limited to: event invites, campaign information, letters, and appeals (unless you have opted-out). 

To Operate, Improve and Maintain our Business, Products and Services
We use the personal data you provide to us to operate our business. For example, when you donate online, we use that information for accounting, audits and other internal functions. When you apply for partnership, freelancing, interning or volunteering, we may use personal data about how you use our products and services to enhance your experience with Unseen and to help us diagnose technical and service problems and administer our Sites.

To Protect Our and Others' Rights, Property or Safety
We may also use your personal data about how you use our Sites to prevent or detect fraud, abuse, illegal use, violations of our Terms of Use, and to comply with court orders, governmental requests, or applicable law.

For General Research and Analysis Purposes
We use data about how our visitors use our Sites to understand viewer behavior or preferences. For example, we may use information about how visitors to our Sites search for and find information to better understand the best ways to organize and present the work that we do. We collect aggregate use information such as the number of hits per page, for internal and marketing use only; we do not provide your personal identifying information to the public. 

Other Purposes
We may also use your personal data in other ways and will provide specific notice at the time of collection and obtain your consent where necessary.

SHARING of Your Personal Data

Unseen’s Sharing

Unseen shares your personal data with:

- Third party service providers processing personal data on Unseen’s behalf. For example to process credit cards and payments, distribute emails, research and analysis, as well as administer certain marketing services and features. When using third party service providers we enter into agreements that require them to implement appropriate technical and organizational measures to protect your personal data. (We would never sell your personal information).

- Other third parties to the extent necessary to: (i) comply with a government request, a court order or applicable law; (ii) defend ourselves against third party claims; and (iii) assist in fraud prevention or investigation (e.g. counterfeiting). 

- To any other third party where you have provided your consent.

To the maximum extent permitted by law, under no circumstances shall Unseen, its officers, directors, employees, or affiliated organizations be liable for any direct, indirect, incidental, special, consequential, or punitive damages, such as, but not limited to, loss of revenue, loss of anticipated profits, goodwill, diminution of value, business interruption costs, or any other intangible losses arising out of damage from any security breach or any other security intrusion.

MANAGEMENT of Your Personal Data

Retention of your Personal Data 

Your personal information will be retained for as long as is necessary to carry out the purposes set out in this Privacy Policy (unless a longer retention period is required by applicable law). For personal data related to any applications, we retain this to keep ongoing communications with the partner, freelancer, intern, or volunteer as necessary.

YOUR RIGHTS Relating to Your Personal Data

You have the right to request: (i) access to your personal data; (ii) an electronic copy of your personal data (portability); (iii) correction of your personal data if it is incomplete or inaccurate; or (iv) deletion or restriction of your personal data in certain circumstances provided by applicable law. These rights are not absolute. Where we have obtained your consent for the processing of your personal data, you have the right to withdraw your consent at any time.

CHANGES to Our Privacy Policy

Applicable law and our practices change over time. If we decide to update our Privacy Policy, we will post the changes on our Sites. If we materially change the way in which we process your personal data, we will provide you with prior notice, or where legally required, and request your consent prior to implementing such changes. We strongly encourage you to read our Privacy Policy and keep yourself informed of our practices.

This Privacy Policy applies to information collected during the application process, information collected during the on-boarding process of Partnership, as well as during continued Partnership. This Privacy Policy describes how Unseen, 614 Main Ave, Fargo, ND 58103 (“Unseen,” “we,” or “us”) collects, uses, and shares your personal data/provided information. 

During this process, this may include any of the following, but not limited to:

- Contact information of key staff or board members (as necessary)
- Budget/Fiscal information
- Donor audience information
- Impact numbers
- Coaching/Consulting information
- Photos/Media files
- Branding/Logo files
- Other information to assist our partnership

Unseen collects and uses personal data only as necessary for the purposes for which it was obtained. Unseen may use your personal data for some or all of the following purposes:

Projects
Unseen is able to provide products to you at no cost, other than your time and energy to see them through. Upon collecting this information, we reference it when it comes to what projects would benefit you and how we can streamline our processes for your growth. It is essential that we keep this information for contacting you to see these projects through.

Some projects require us to ask for login information to certain programs that you use in order to assist with a project (e.g. MailChimp accounts, websites, donor management systems). During this time, Unseen obtains access to confidential information about your donors/supporters. Unseen will never solicit your donors for any reason.

Coaching/Fundraising Conversations
Unseen may ask for general information about your donors to retain a better understanding of your donor audience (e.g. geographical regions, age ranges, corporations, etc.) so we can assist you and provide high quality fundraising coaching and advice. If the Partner discloses any specific information about a corporation, family foundation, donor, etc., Unseen will never solicit those donors for any reason.

Measurement

Unseen carefully vets each project to make sure it is useful and will make a significant impact in the work that you do. We use your provided data to not only measure your growth, but to measure Unseen’s impact as well.

Customer service

Unseen uses your information to provide you with customer service, including responses to your inquiries, complaints, and general feedback about our products and processes. Customer service may be provided through various forms of communication, including via email, letter, telephone, and other online features.

Development
Unseen sometimes shares specific stories of Unseen Partners, their growth, and the work they are doing to donors on a one-on-one basis for the purpose of cultivating donor gifts. Unseen may also distribute a service mapping matrix that lists names of organizations connected with trafficking problems and solutions.

Marketing
Unseen shares general stories about your organization’s impact, growth, and general region to provide context behind the story, name of your organization, and testimonials in our social media, newsletters, and websites if it is already shared publicly elsewhere. 

Third Party Collaboration

Unseen works with trustworthy coaches, creatives, other vendors, and may share necessary information with them as they work to help complete projects and provide services to Unseen and our Partners.

Release of Media and Media Privacy

We believe in sharing hope over darkness. We care deeply about protecting the dignity of people and highlighting their strength and humanity, and take steps to tell that story well through the communication pieces we create for you.

Use of Media for Unseen Partner Projects
Initial projects are often completed by using some of your existing photos, branding, or other media. We’ll ask you to provide high quality versions of these elements to use as needed, so it is the Partner's responsibility to let us know of any copyright or distribution agreements with other artists. If there is a reason we should not use specific media (confidentiality of person in photo, agreement with the artist who originally created the media, etc.) the Partner should let us know when photos or footage are sent to Unseen. We want to honor and represent your work, and the artist’s work, in a credited, and dignified way!

Use of Testimonials and Shared Public Information
Information and quotes you share with our staff about the use of our products and services, or general public information about your organization, may be shared with Unseen’s staff and support base to improve our services and retain and attract donors—unless privacy exceptions have been made during your on-boarding process. (e.g. “These brochures have really helped us grow!”)

Use of Public Information
Unseen may share any information you’ve released publicly with our staff, donors, or potential donors. Public information may include a compelling story from a public newsletter, public social media post, news article, information on your website, or other information available on the internet. If re-sharing is a concern for you due to privacy or security reasons—perhaps you have a private newsletter list for security—it is the Partner's responsibility to inform Unseen so we can adhere to this restriction.

Confidentiality
Unseen will not share any information that you have specified as confidential.

Unseen-Created Media Ownership

The materials created by Unseen are for the benefit of you, our partner. You get “distribution rights,” meaning the ability to print and share as you want. Unseen retains “ownership rights,” meaning the control of edits, changes, and creation of the media piece. This also applies to photos and videos captured by Unseen.

Stock photos may be used for projects if the Partner does not have photos available to use (e.g. poor quality photos, confidentiality, etc.). If Unseen purchases the stock photo, then we retain "ownership rights," meaning we can use the photo in materials outside the originally created product. We comply with any agreements that are tied to the stock photo at the time of purchasing the image. The Partner only has the rights to use it with the product (e.g. If a stock photo was purchased for a project, then you are free to use the photo only in context of that specific project). However, if the Partner purchases the stock photo, then you retain "ownership rights" and can use the photo wherever you please (online, social media, emails, other printed materials, etc.), as long as you are complying with the stock photo agreements.

We may send equipment and/or provide training for you to capture images or video. Unseen may use the images and video collected in our own media unless you choose to limit our usage of those images. It’s our intent to comply with any privacy concerns you have relating to the use of images of the people you serve.

Unseen provides and retains design and creative control on media projects. You guide this process through feedback and discussion at the onset and throughout all projects to set our artists up for success. Our staff will ask you to submit all necessary information, follow through on distribution plans we create together and follow up after the project is done.

Creatives, Coaches, Third-Party Vendors

This Privacy Policy describes how Unseen, 614 Main Ave, Fargo, ND 58103 (“Unseen,” “we,” or “us”) collects, uses, and shares your personal data/provided information, as well as describes the Contributor’s (“you”, “your”) commitment to protect the privacy of Unseen Partners (“our partners”, “partners”). A Contributor is anyone who works with Unseen as a Creative, Coach, or third-party Vendor.

We believe in sharing hope over darkness. We care deeply about protecting the dignity of people and highlighting their strength and humanity, and take steps to tell that story well through the communication pieces we create for our partners.

As a Contributor to the work of Unseen, you agree that any and all information about Unseen Partners is confidential and you agree to keep any and all information about our partners, proposed partners, and all partner information/communication with our partners confidential. You agree not to disclose any information about or received from Unseen or Unseen Partners to anyone other than Unseen.

Many Unseen Partners have specific requests as to what can and cannot be shared about their organization and the people they serve. These requests are to protect their identity and keep them safe, as some of our partners are serving in high risk areas around the world. Even a seemingly inconsequential social media or blog post could put lives at risk and their work in danger.

What is okay to share?

Unseen Partner Organization Names: Many of our partners have public websites and social media pages. You are free to know who these groups are, support them as you feel called, and share their work with your friends, family and peers. We LOVE our partners and want others to love them too.

Completed Projects:

- You are free to share with your friends, family and peers about the work you are creating and use the completed files for your portfolio—unless told otherwise, due to the specific security needs of a partner. 

- Please do not post anything online (including but not limited to: online portfolios, websites, Instagram, Facebook, Tumblr, etc.) that includes personal contact information (first and last personal names, personal addresses, specific locations) about our partners, unless given consent from Unseen. (E.g. image of a business card, containing personal information)

- Most of the projects you will complete are public and okay to share, but it’s always best to ask before publishing online—better to be safe than sorry! :)

What is not okay to share?

Unseen Partners’ Locations: If the project you’re completing discloses the country or location of our partner, please check with Unseen before posting images online or mentioning anything associated with their location online. 

Unseen Partners’ Personal Information: It is rare that you would have access to personal names, email addresses, mailing addresses and/or other information about our partners, other than the content for the product you are creating. However, there may be a case where you receive this type of information. This information is not to be released to anyone other than Unseen.

Unseen Partners’ Religious Practices/Associations:

- Many of our partners have undergone extensive edits in their marketing materials to edit out religious lingo in their print and online presence for the safety and security of those they serve. Never post anything online that shares the religious beliefs of Unseen Partners.

- Also, if you write an article or host a blog that highlights your own personal religious practices, please don’t highlight our partners or their work on your website, blog, or social media. Associating their work with your beliefs may place our partners at risk.

- Overall, if our partner wants to highlight their religious work on their own website or social media sources, that’s great. However, please do not add content to the web in case security measures have to be tightened up in the future.
